1. Agreeing to these terms

Mental Wealth Solutions, Inc. owns and operates CouchConnections. By using Couch Commons, creating an account, or purchasing a membership, you agree to these Terms and our Privacy page. If you purchase for a practice or other organization, you represent that you have authority to bind it. You must be at least 18.

2. What Couch Commons is

Couch Commons is a therapist directory and publishing platform. It is not a healthcare provider, emergency service, licensing board, credentialing organization, insurer, law firm, or referral agency. Using the directory does not create a therapist-client relationship with Couch Commons, and information on the site is not medical or legal advice.

We do not promise that a clinician will receive inquiries, patients, revenue, search ranking, or any other business result. We do not sell placement, and payment does not determine search order.

3. Clinician accounts and information

You must provide accurate, current information and keep it current. You are responsible for activity under your account and for safeguarding access to your email. A practice purchasing for multiple clinicians is responsible for having each clinician's authority to submit and publish their information.

Each clinician may have one individual Couch Commons account. Do not create a second account using another email address. A practice may manage separate accounts for separate clinicians, but one professional licence cannot be attached to two accounts. Contact us if an email, ownership, or practice relationship needs to change.

You remain solely responsible for your licence, scope of practice, professional obligations, advertising, client relationships, and compliance with the laws and rules that apply to you.

4. Licence checks and publication

You authorize Couch Commons to check the licensing information you provide against public state registries and to re-check it while your profile is published. A receipt reports what a registry returned at a particular time; it is not an endorsement or a guarantee of fitness, standing, competence, identity, or future status.

We will make reasonable efforts to verify the information you provide. We may use automated registry checks, human review, and documents or information we request from you. If we still cannot verify your licence, you will not receive a verified designation or verification receipt. An inconclusive check is not a finding that your licence is invalid.

Payment starts membership and access to onboarding. The membership fee pays for access to the platform and is not contingent on a successful verification result. We may withhold publication or delay, pause, correct, or remove a profile when information cannot be verified, a registry is unavailable or unsupported, information is incomplete or inconsistent, or action is needed to protect users or the integrity of the directory.

5. Membership, recurring billing, and cancellation

Clinician membership is $19.99 per month unless a different price is clearly shown before you purchase. By purchasing, you authorize us and our payment processor to charge the payment method you provide now and automatically each month until you cancel. Taxes may be added when required. We will disclose material price changes before they take effect as required by law.

You may cancel at any time through the billing portal in your account. Cancellation stops the next renewal; it does not reverse a charge already made. Your paid membership continues through the end of the current billing period unless we suspend or terminate it under these Terms.

7. Your content

You keep ownership of content you submit. You give Couch Commons a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, distribute, and promote that content as needed to operate and market the service. This licence ends when the content is removed, except for reasonable backups, legal records, and material already shared outside our control.

You represent that you have the rights and permissions needed for anything you submit and that it is accurate, lawful, and does not violate another person's privacy, publicity, intellectual property, or other rights. You approve every word of a profile or article before it is public, including any draft made with automated tools.

8. Acceptable use

You may not use Couch Commons to:

• impersonate anyone or submit false licensing or professional information;
• harass, exploit, discriminate against, deceive, or harm another person;
• publish unlawful, infringing, malicious, or privacy-invasive material;
• scrape, probe, overload, reverse engineer, or interfere with the service or its security;
• send spam or use directory information to build or sell marketing lists; or
• use the service in a way that violates law or professional rules.

9. Third-party services and clinicians

Couch Commons uses third-party services, including Stripe, and links to independent websites and public registries. Their terms and practices apply to their services. Clinicians listed on Couch Commons are independent of Couch Commons. We do not supervise their care and are not responsible for their acts, omissions, availability, fees, or services.

10. Suspension and termination

You may stop using the service at any time. We may restrict, suspend, or terminate access or remove content when we reasonably believe these Terms were violated, information is false or cannot be verified, payment is overdue, continued access creates risk, or the service is being discontinued. Sections that by their nature should survive termination will survive.

11. Service changes and availability

We may add, change, suspend, or discontinue features. We do not promise uninterrupted or error-free service, permanent storage, a particular search-engine result, or that every state registry will remain available. We will not materially change an active paid subscription without any notice required by applicable law.

12. Disclaimers

To the maximum extent permitted by law, Couch Commons is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Couch Commons and its owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or clients. Our total liability arising out of the service or these Terms will not exceed the amount you paid to Couch Commons during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not allow them.

14. Changes to these terms

We may update these Terms. If a change materially affects an active paid membership, we will provide notice as required by law. The effective date at the top shows when these Terms were last updated. Continuing to use the service after updated Terms take effect means you accept them, except where the law requires another form of consent.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of- law rules. Any dispute must be brought in a state or federal court located in New York, and each party consents to those courts. Nothing here limits rights or remedies that cannot be waived under applicable law.
